Article 1 \u2014 Purpose and scope<\/h2>\n\n\n\n

These Terms and Conditions of Sale (hereinafter the \u201cT&Cs\u201d) govern every order placed on the xaviers.photo website by a buyer (hereinafter the \u201cClient\u201d) with Xavier Sch\u00e4llebaum, photographer and artist-author (hereinafter the \u201cSeller\u201d or the \u201cArtist\u201d).<\/p>\n\n\n\n

The T&Cs apply without restriction or reservation to every order of limited-edition art prints. The Client acknowledges having read and accepted the T&Cs before validating their order, by ticking the box provided for that purpose.<\/p>\n\n\n\n

Article 2 \u2014 Characteristics of the works<\/h2>\n\n\n\n

The photographs offered on the xaviers.photo website are limited-edition art prints, conforming to the status of original work of art as defined in article 98 A of annex III of the French General Tax Code. Each edition is strictly limited to thirty (30) copies at most, all formats and media combined, artist\u2019s proofs included<\/strong>. The website uses the word \u201cprint\u201d where these terms and conditions use the word \u201ccopy\u201d: both designate the same numbered and signed impression of the edition. The first three numbers of each edition (1, 2 and 3) are reserved for artist\u2019s proofs; prints offered for public sale therefore begin at number 4. Beyond thirty copies, no further print may ever be made, in any format or on any medium.<\/p>\n\n\n\n

Each print is:<\/p>\n\n\n\n

  • Numbered<\/li>\n\n\n\n
  • Signed by hand by the Artist<\/li>\n\n\n\n
  • Accompanied by an original certificate of authenticity, numbered, dated, signed and sealed<\/li>\n\n\n\n
  • Fitted with a numbered back authentication label signed by the Artist, affixed to the back of the work (or its support)<\/li>\n<\/ul>\n\n\n\n

    The technical characteristics (printing technique, paper, format, finish) are specified on each work\u2019s detailed page.<\/p>\n\n\n\n

    The photographs presented on the site are reproduced with the greatest care, but minor chromatic variations are possible between on-screen display and the final print, owing to differences in calibration, lighting and medium. Such variations cannot engage the Seller\u2019s liability.<\/p>\n\n\n\n

    Article 3 \u2014 Prices<\/h2>\n\n\n\n

    Prices are stated in euros inclusive of all taxes, including VAT at the reduced rate of 5.5% applicable to original works of art (article 278-0 bis of the French General Tax Code). This preferential taxation applies as of right once the conditions of the original work are met (edition limited to 30 copies in total, artist\u2019s proofs included, numbering, artist\u2019s signature).<\/p>\n\n\n\n

    Prices do not include shipping costs, which are stated separately before the order is validated.<\/p>\n\n\n\n

    The price of each print is calculated according to the chosen dimensions (to the centimetre), the printing technique and the framing option<\/strong> selected by the Client. The dimensions respect in all circumstances the proportions (the aspect ratio) specific to each work: the length is free from 60 cm upwards<\/strong> and up to a maximum dimension which depends on the printing technique and framing chosen<\/strong>. These minimum and maximum dimensions are specified on each work\u2019s page and on the \u201cPrints & Editions\u201d page.<\/p>\n\n\n\n

    The price displayed on the work\u2019s page updates in real time according to these choices. It includes the print, its studio finish and, where applicable, the chosen framing. The hanging system<\/strong> (recessed frame or wooden rail depending on dimensions) is included at no extra charge for plexiglass prints, framed or not, and for framed paper prints. Paper prints \u2014 Fine Art Baryta and Ilford Lambda silver halide \u2014 ordered without framing are supplied as a loose sheet, carefully rolled in a protective tube<\/strong>; they have neither rigid mounting nor a hanging system. The price does not include shipping costs.<\/p>\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n

    The price of a print offered for public sale also progresses according to the number available in the edition:<\/p>\n\n\n\n

    • Prints 4 to 10: base price (Tier I)<\/li>\n\n\n\n
    • Prints 11 to 20: base price plus 25% (Tier II)<\/li>\n\n\n\n
    • Prints 21 to 30: base price plus 50% (Tier III)<\/li>\n<\/ul>\n\n\n\n

      This number-based increase applies to the artistic part of the print<\/strong> (printing, finish and, where applicable, mounting); it does not apply to the framing supplement.<\/p>\n\n\n\n

      The artist\u2019s proofs (numbers 1 to 3)<\/strong> are not offered for open sale on the site: they are the object of an acquisition at the Artist\u2019s invitation, at a price agreed privately<\/strong> between the Artist and the acquirer. The acquirer then receives a personal private link allowing them to finalise their acquisition online, under the same terms and with the same documents as any other print.<\/p>\n\n\n\n

      The price displayed on the page at the time of ordering is the one that applies.<\/p>\n\n\n\n

      The Artist reserves the right to change his prices at any time, it being understood that works will be invoiced on the basis of the rates in force at the time the order is registered.<\/p>\n\n\n\n

      Article 4 \u2014 Order, reservation and confirmation<\/h2>\n\n\n\n

      Orders are placed exclusively online on the xaviers.photo website. The Client selects the work, the printing technique, the framing and the desired dimensions, adds the product to the cart, and proceeds to payment after accepting these T&Cs.<\/p>\n\n\n\n

      When a print is added to the cart, the corresponding print number is reserved for sixty (60) minutes.<\/strong> During this period, that number is no longer offered to other buyers. If payment is not completed within this 60-minute period, the reservation is automatically cancelled and the print number becomes available for sale again to other Clients.<\/p>\n\n\n\n

      The order becomes firm and final upon receipt of full payment. As soon as payment is validated, the Client receives a confirmation email and has access, in their personal space (\u201cMy orders\u201d section), once their account has been activated, to an order form, an invoice and a provisional certificate of authenticity.<\/strong><\/p>\n\n\n\n

      The Artist reserves the right to refuse any order on any legitimate ground, in particular exhaustion of the edition, a pricing error, or suspicion of fraud. In such a case, the Client is refunded immediately.<\/p>\n\n\n\n

      Article 5 \u2014 Payment<\/h2>\n\n\n\n

      Payment is made online by bank card (Visa, Mastercard, American Express), Apple Pay, Google Pay, Bancontact or iDEAL via the secure Stripe platform, certified PCI-DSS level 1, or by SEPA bank transfer. Where payment is made by bank transfer, the order is confirmed upon receipt of the transfer. No banking data is retained by the Seller.<\/p>\n\n\n\n

      Instalment or deferred payment may be offered via Klarna, subject to eligibility as determined by that provider (amount, country, buyer profile), under the conditions displayed at the time of payment. The Seller is paid the full price at the time of the order; the payment facility constitutes a separate contract between the Client and Klarna.<\/p>\n\n\n\n

      For professional or institutional buyers, or buyers established outside the European Union, a proforma invoice<\/strong> is issued for every order, prior to payment. It is made available in the Client’s personal space, under “My orders”, as soon as the order is validated. A Client who has not opened a personal space may obtain it on request to contact@xaviers.photo. This document has no accounting value and is intended for import formalities, insurance purposes or internal acquisition procedures; only the final invoice issued after payment is authoritative.<\/p>\n\n\n\n

      Article 6 \u2014 Production and lead times<\/h2>\n\n\n\n

      Each print is made to order at the Artist\u2019s reference atelier in Paris (atelier PICTO). Usual lead times are:<\/p>\n\n\n\n

      • Production of the print: 7 to 10 working days<\/li>\n\n\n\n
      • Plexiglass mounting (if applicable): 5 additional working days<\/li>\n\n\n\n
      • Framing (if applicable): 5 additional working days<\/li>\n\n\n\n
      • Preparation and dispatch: 2 working days<\/li>\n\n\n\n
      • Carriage by DHL Express, from collection at the studio: metropolitan France 1 to 2 working days; European Union 1 to 4 working days; other destinations 2 to 7 working days, excluding customs formalities. These times are indicative; works carried by a specialist carrier (Article 7) are given a delivery time before dispatch<\/li>\n<\/ul>\n\n\n\n

        The Seller will endeavour to meet these lead times. Any significant overrun will be notified to the Client by email.<\/p>\n\n\n\n

        Article 7 \u2014 Delivery<\/h2>\n\n\n\n

        7.1 Carrier.<\/strong> Works are entrusted to DHL Express, a door-to-door, time-definite express service with tracking. Mounted or framed works whose packed dimensions exceed 150 cm in their longest overall dimension, frame included, are carried crated by DHL Express or by a specialist fine-art carrier, depending on destination and packing. Their shipping price appears in the scale below and is shown to the Client before the order is placed.<\/p>\n\n\n\n

        7.2 Packing and insurance.<\/strong> Each work is packed individually by the studio, in packaging that meets the carrier’s requirements (tube, reinforced carton or crate, depending on size and finish), and photographed before closing. Each shipment is insured for the whole journey under declared-value insurance taken out with the carrier, for the invoiced price of the work.<\/p>\n\n\n\n

        7.3 Handover.<\/strong> The work is handed over only against the signature of the recipient or of a person they have designated. On dispatch, the Client receives a tracking number from the carrier and may, through DHL Express On Demand Delivery, choose the delivery day or give another address. For works priced above \u20ac3,000, handover may be subject to presentation of a delivery code sent to the Client. Saturday delivery, delivery before noon and delivery without any mention of the price (gifts) are available on request to contact@xaviers.photo before dispatch, under the conditions stated on the \u201cShipping & returns\u201d page.<\/p>\n\n\n\n

        7.4 Shipping charges.<\/strong> Shipping charges depend on the destination and on the size band of the work (longest overall dimension, frame included). They apply per print<\/strong> and are added together when an order contains several prints, each work being packed separately. The current schedule is as follows:<\/p>\n\n\n\n

        The largest size that can be ordered online is 275 cm overall. French Polynesia, New Caledonia and Wallis and Futuna: \u20ac300 up to 85 cm; beyond that, as for other distant destinations, shipping is agreed with the Seller before the order \u2014 please contact us at contact@xaviers.photo. These amounts include VAT for mainland France and the European Union; for other destinations they are exempt from VAT. The exact amount is shown on the work’s page according to the chosen size, then again before payment is confirmed<\/strong>. Paper prints ordered without framing travel rolled in a tube: they are charged at the first band up to 130 cm and at the second beyond that, whatever the size.<\/p>\n\n\n\n

        7.5 Deliveries outside the European Union.<\/strong> Customs duties, import VAT and any local taxes are payable by the Client to the carrier on arrival, which may add a handling fee (Incoterm DAP). For deliveries to the United States: works of art and photographs currently benefit from exemptions from US customs duties; as US customs regulations are subject to change, any duties, import taxes and local taxes (sales tax\/use tax) remain the sole responsibility of the Client.<\/p>\n\n\n\n

        7.6 Receipt.<\/strong> On receipt, the Client is asked to check the condition of the packaging and of the work in the presence of the courier and, in the event of visible damage, to refuse delivery or to write precise, reasoned reservations on the delivery record, then to inform the Seller within forty-eight hours at contact@xaviers.photo, with photographs, so that the claim can be filed with the insurer within the seven-day period it imposes. In accordance with Articles L. 216-4 and L. 221-15 of the French Consumer Code, risk passes to the Client when they take possession of the work and the Seller remains liable for the proper performance of the delivery; the absence of reservations does not deprive the Client of the guarantees provided for in Articles 8 and 9. Please note that, in the absence of reservations, any action against the carrier is time-barred after three days under Article L. 133-3 of the French Commercial Code, extended to ten days under the conditions of Article L. 224-65 of the Consumer Code.<\/p>\n\n\n\n

        Article 8 \u2014 Works made to order and right of withdrawal<\/h2>\n\n\n\n

        XAVIER S. art prints are works made to order: each copy is printed, numbered and signed specifically for the Client, according to the choices they express when ordering (dimensions, printing technique, finish and, where applicable, framing). No copy is held in stock prior to the order.<\/p>\n\n\n\n

        Consequently, in accordance with article L.221-28, 3\u00b0 of the French Consumer Code, which excludes the right of withdrawal for goods made to the consumer\u2019s specifications or clearly personalised, the sale of a XAVIER S. art print does not carry a right of withdrawal<\/strong>.<\/p>\n\n\n\n

        The Client is informed of this exclusion clearly and in advance, before validating their order, and expressly accepts it by ticking the box provided for that purpose at the time of payment. This information is restated on the order form and on the delivery note provided to them.<\/p>\n\n\n\n

        The signing of the work\u2019s delivery note, carried out electronically from the \u201cMy orders\u201d area on xaviers.photo, attests that the work has been delivered conforming and in perfect apparent condition. It triggers the conversion of the provisional certificate of authenticity into the final certificate of authenticity<\/strong>, available in digital form (bearing a verification QR code, accessible from the \u201cMy orders\u201d area) and in a paper version delivered with the work. The work is also accompanied by its numbered back authentication label signed by the Artist.<\/p>\n\n\n\n

        This exclusion of the right of withdrawal deprives the Client of no legal guarantee: the legal guarantee of conformity (articles L.217-3 et seq. of the French Consumer Code) and the guarantee against hidden defects (articles 1641 et seq. of the French Civil Code) remain fully applicable (see Article 9). In the event of a work damaged in transit or not conforming to the order, the Artist bears the cost of return as well as replacement or refund, at no cost to the Client.<\/p>\n\n\n\n

        A return is therefore possible only if the work arrives damaged<\/strong> or does not match the options of the order<\/strong> (printing technique, format, finish, framing, print number). In both cases the Artist covers the full cost of return and replacement, under the conditions set out in Articles 7 and 9.<\/p>\n\n\n\n

        Article 9 \u2014 Guarantees<\/h2>\n\n\n\n

        The Artist is bound by the legal guarantees of conformity (articles L.217-3 et seq. of the French Consumer Code) and against hidden defects (articles 1641 et seq. of the French Civil Code). These guarantees entitle the Client to a replacement, a refund or a price reduction in the event of a defect affecting the work.<\/p>\n\n\n\n

        Any claim must be sent by email to contact@xaviers.photo, accompanied by photographs of the defect and the certificate of authenticity, within a reasonable time of its discovery.<\/p>\n\n\n\n

        The following statutory notice is required by article D. 211-2 of the French Consumer Code and is reproduced here verbatim in French, as the sale is governed by French law.<\/em><\/p>\n\n\n\n

        Garanties l\u00e9gales \u2014 encadr\u00e9 pr\u00e9vu \u00e0 l\u2019article D. 211-2 du code de la consommation<\/strong><\/p>\n\n\n\n

        Le consommateur dispose d\u2019un d\u00e9lai de deux ans \u00e0 compter de la d\u00e9livrance du bien pour obtenir la mise en \u0153uvre de la garantie l\u00e9gale de conformit\u00e9 en cas d\u2019apparition d\u2019un d\u00e9faut de conformit\u00e9. Durant ce d\u00e9lai, le consommateur n\u2019est tenu d\u2019\u00e9tablir que l\u2019existence du d\u00e9faut de conformit\u00e9 et non la date d\u2019apparition de celui-ci.<\/p>\n\n\n\n

        Lorsque le contrat de vente du bien pr\u00e9voit la fourniture d\u2019un contenu num\u00e9rique ou d\u2019un service num\u00e9rique de mani\u00e8re continue pendant une dur\u00e9e sup\u00e9rieure \u00e0 deux ans, la garantie l\u00e9gale est applicable \u00e0 ce contenu num\u00e9rique ou ce service num\u00e9rique tout au long de la p\u00e9riode de fourniture pr\u00e9vue. Durant ce d\u00e9lai, le consommateur n\u2019est tenu d\u2019\u00e9tablir que l\u2019existence du d\u00e9faut de conformit\u00e9 affectant le contenu num\u00e9rique ou le service num\u00e9rique et non la date d\u2019apparition de celui-ci.<\/p>\n\n\n\n

        La garantie l\u00e9gale de conformit\u00e9 emporte obligation pour le professionnel, le cas \u00e9ch\u00e9ant, de fournir toutes les mises \u00e0 jour n\u00e9cessaires au maintien de la conformit\u00e9 du bien.<\/p>\n\n\n\n

        La garantie l\u00e9gale de conformit\u00e9 donne au consommateur droit \u00e0 la r\u00e9paration ou au remplacement du bien dans un d\u00e9lai de trente jours suivant sa demande, sans frais et sans inconv\u00e9nient majeur pour lui.<\/p>\n\n\n\n

        Si le bien est r\u00e9par\u00e9 dans le cadre de la garantie l\u00e9gale de conformit\u00e9, le consommateur b\u00e9n\u00e9ficie d\u2019une extension de six mois de la garantie initiale.<\/p>\n\n\n\n

        Si le consommateur demande la r\u00e9paration du bien, mais que le vendeur impose le remplacement, la garantie l\u00e9gale de conformit\u00e9 est renouvel\u00e9e pour une p\u00e9riode de deux ans \u00e0 compter de la date de remplacement du bien.<\/p>\n\n\n\n

        Le consommateur peut obtenir une r\u00e9duction du prix d\u2019achat en conservant le bien ou mettre fin au contrat en se faisant rembourser int\u00e9gralement contre restitution du bien, si :<\/p>\n\n\n\n

        1\u00b0 Le professionnel refuse de r\u00e9parer ou de remplacer le bien ;<\/p>\n\n\n\n

        2\u00b0 La r\u00e9paration ou le remplacement du bien intervient apr\u00e8s un d\u00e9lai de trente jours ;<\/p>\n\n\n\n

        3\u00b0 La r\u00e9paration ou le remplacement du bien occasionne un inconv\u00e9nient majeur pour le consommateur, notamment lorsque le consommateur supporte d\u00e9finitivement les frais de reprise ou d\u2019enl\u00e8vement du bien non conforme, ou s\u2019il supporte les frais d\u2019installation du bien r\u00e9par\u00e9 ou de remplacement ;<\/p>\n\n\n\n

        4\u00b0 La non-conformit\u00e9 du bien persiste en d\u00e9pit de la tentative de mise en conformit\u00e9 du vendeur rest\u00e9e infructueuse.<\/p>\n\n\n\n

        Le consommateur a \u00e9galement droit \u00e0 une r\u00e9duction du prix du bien ou \u00e0 la r\u00e9solution du contrat lorsque le d\u00e9faut de conformit\u00e9 est si grave qu\u2019il justifie que la r\u00e9duction du prix ou la r\u00e9solution du contrat soit imm\u00e9diate. Le consommateur n\u2019est alors pas tenu de demander la r\u00e9paration ou le remplacement du bien au pr\u00e9alable.<\/p>\n\n\n\n

        Le consommateur n\u2019a pas droit \u00e0 la r\u00e9solution de la vente si le d\u00e9faut de conformit\u00e9 est mineur.<\/p>\n\n\n\n

        Toute p\u00e9riode d\u2019immobilisation du bien en vue de sa r\u00e9paration ou de son remplacement suspend la garantie qui restait \u00e0 courir jusqu\u2019\u00e0 la d\u00e9livrance du bien remis en \u00e9tat.<\/p>\n\n\n\n

        Les droits mentionn\u00e9s ci-dessus r\u00e9sultent de l\u2019application des articles L. 217-1 \u00e0 L. 217-32 du code de la consommation.<\/p>\n\n\n\n

        Le vendeur qui fait obstacle de mauvaise foi \u00e0 la mise en \u0153uvre de la garantie l\u00e9gale de conformit\u00e9 encourt une amende civile d\u2019un montant maximal de 300 000 euros, qui peut \u00eatre port\u00e9 jusqu\u2019\u00e0 10 % du chiffre d\u2019affaires moyen annuel (article L. 241-5 du code de la consommation).<\/p>\n\n\n\n

        Le consommateur b\u00e9n\u00e9ficie \u00e9galement de la garantie l\u00e9gale des vices cach\u00e9s en application des articles 1641 \u00e0 1649 du code civil, pendant une dur\u00e9e de deux ans \u00e0 compter de la d\u00e9couverte du d\u00e9faut. Cette garantie donne droit \u00e0 une r\u00e9duction de prix si le bien est conserv\u00e9 ou \u00e0 un remboursement int\u00e9gral contre restitution du bien.<\/p>\n\n<\/div>\n\n\n\n

        Article 10 \u2014 Intellectual property and use<\/h2>\n\n\n\n

        The purchase of a print conveys ownership of the material object (the print and its certificate) but conveys no assignment of copyright in the photographic work. In particular, the Client is not authorised to:<\/p>\n\n\n\n
