Article 1 — Purpose and scope
These Terms and Conditions of Sale (hereinafter the “T&Cs”) govern every order placed on the xaviers.photo website by a buyer (hereinafter the “Client”) with Xavier Schällebaum, photographer and artist-author (hereinafter the “Seller” or the “Artist”).
The T&Cs apply without restriction or reservation to every order of limited-edition art prints. The Client acknowledges having read and accepted the T&Cs before validating their order, by ticking the box provided for that purpose.
Article 2 — Characteristics of the works
The photographs offered on the xaviers.photo website are limited-edition art prints, conforming to the status of original work of art as defined in article 98 A of annex III of the French General Tax Code. Each edition is strictly limited to thirty (30) copies at most, all formats and media combined, artist’s proofs included. The website uses the word “print” where these terms and conditions use the word “copy”: both designate the same numbered and signed impression of the edition. The first three numbers of each edition (1, 2 and 3) are reserved for artist’s proofs; prints offered for public sale therefore begin at number 4. Beyond thirty copies, no further print may ever be made, in any format or on any medium.
Each print is:
- Numbered
- Signed by hand by the Artist
- Accompanied by an original certificate of authenticity, numbered, dated, signed and sealed
- Fitted with a numbered back authentication label signed by the Artist, affixed to the back of the work (or its support)
The technical characteristics (printing technique, paper, format, finish) are specified on each work’s detailed page.
The photographs presented on the site are reproduced with the greatest care, but minor chromatic variations are possible between on-screen display and the final print, owing to differences in calibration, lighting and medium. Such variations cannot engage the Seller’s liability.
Article 3 — Prices
Prices are stated in euros inclusive of all taxes, including VAT at the reduced rate of 5.5% applicable to original works of art (article 278-0 bis of the French General Tax Code). This preferential taxation applies as of right once the conditions of the original work are met (edition limited to 30 copies in total, artist’s proofs included, numbering, artist’s signature).
Prices do not include shipping costs, which are stated separately before the order is validated.
The price of each print is calculated according to the chosen dimensions (to the centimetre), the printing technique and the framing option selected by the Client. The dimensions respect in all circumstances the proportions (the aspect ratio) specific to each work: the length is free from 60 cm upwards and up to a maximum dimension which depends on the printing technique and framing chosen. These minimum and maximum dimensions are specified on each work’s page and on the “Prints & Editions” page.
The price displayed on the work’s page updates in real time according to these choices. It includes the print, its studio finish and, where applicable, the chosen framing. The hanging system (recessed frame or wooden rail depending on dimensions) is included at no extra charge for plexiglass prints, framed or not, and for framed paper prints. Paper prints — Fine Art Baryta and Ilford Lambda silver halide — ordered without framing are supplied as a loose sheet, carefully rolled in a protective tube; they have neither rigid mounting nor a hanging system. The price does not include shipping costs.
The price of a print offered for public sale also progresses according to the number available in the edition:
- Prints 4 to 10: base price (Tier I)
- Prints 11 to 20: base price plus 25% (Tier II)
- Prints 21 to 30: base price plus 50% (Tier III)
This number-based increase applies to the artistic part of the print (printing, finish and, where applicable, mounting); it does not apply to the framing supplement.
The artist’s proofs (numbers 1 to 3) are not offered for open sale on the site: they are the object of an acquisition at the Artist’s invitation, at a price agreed privately between the Artist and the acquirer. The acquirer then receives a personal private link allowing them to finalise their acquisition online, under the same terms and with the same documents as any other print.
The price displayed on the page at the time of ordering is the one that applies.
The Artist reserves the right to change his prices at any time, it being understood that works will be invoiced on the basis of the rates in force at the time the order is registered.
Article 4 — Order, reservation and confirmation
Orders are placed exclusively online on the xaviers.photo website. The Client selects the work, the printing technique, the framing and the desired dimensions, adds the product to the cart, and proceeds to payment after accepting these T&Cs.
When a print is added to the cart, the corresponding print number is reserved for sixty (60) minutes. During this period, that number is no longer offered to other buyers. If payment is not completed within this 60-minute period, the reservation is automatically cancelled and the print number becomes available for sale again to other Clients.
The order becomes firm and final upon receipt of full payment. As soon as payment is validated, the Client receives a confirmation email and has access, in their personal space (“My orders” section), once their account has been activated, to an order form, an invoice and a provisional certificate of authenticity.
The Artist reserves the right to refuse any order on any legitimate ground, in particular exhaustion of the edition, a pricing error, or suspicion of fraud. In such a case, the Client is refunded immediately.
Article 5 — Payment
Payment is made online by bank card (Visa, Mastercard, American Express), Apple Pay, Google Pay, Bancontact or iDEAL via the secure Stripe platform, certified PCI-DSS level 1, or by SEPA bank transfer. Where payment is made by bank transfer, the order is confirmed upon receipt of the transfer. No banking data is retained by the Seller.
Instalment or deferred payment may be offered via Klarna, subject to eligibility as determined by that provider (amount, country, buyer profile), under the conditions displayed at the time of payment. The Seller is paid the full price at the time of the order; the payment facility constitutes a separate contract between the Client and Klarna.
For professional or institutional buyers, or buyers established outside the European Union, a proforma invoice is issued for every order, prior to payment. It is made available in the Client’s personal space, under “My orders”, as soon as the order is validated. A Client who has not opened a personal space may obtain it on request to contact@xaviers.photo. This document has no accounting value and is intended for import formalities, insurance purposes or internal acquisition procedures; only the final invoice issued after payment is authoritative.
Article 6 — Production and lead times
Each print is made to order at the Artist’s reference atelier in Paris (atelier PICTO). Usual lead times are:
- Production of the print: 7 to 10 working days
- Plexiglass mounting (if applicable): 5 additional working days
- Framing (if applicable): 5 additional working days
- Preparation and dispatch: 2 working days
- Carriage by DHL Express, from collection at the studio: metropolitan France 1 to 2 working days; European Union 1 to 4 working days; other destinations 2 to 7 working days, excluding customs formalities. These times are indicative; works carried by a specialist carrier (Article 7) are given a delivery time before dispatch
The Seller will endeavour to meet these lead times. Any significant overrun will be notified to the Client by email.
Article 7 — Delivery
7.1 Carrier. Works are entrusted to DHL Express, a door-to-door, time-definite express service with tracking. Mounted or framed works whose packed dimensions exceed 150 cm in their longest overall dimension, frame included, are carried crated by DHL Express or by a specialist fine-art carrier, depending on destination and packing. Their shipping price appears in the scale below and is shown to the Client before the order is placed.
7.2 Packing and insurance. Each work is packed individually by the studio, in packaging that meets the carrier’s requirements (tube, reinforced carton or crate, depending on size and finish), and photographed before closing. Each shipment is insured for the whole journey under declared-value insurance taken out with the carrier, for the invoiced price of the work.
7.3 Handover. The work is handed over only against the signature of the recipient or of a person they have designated. On dispatch, the Client receives a tracking number from the carrier and may, through DHL Express On Demand Delivery, choose the delivery day or give another address. For works priced above €3,000, handover may be subject to presentation of a delivery code sent to the Client. Saturday delivery, delivery before noon and delivery without any mention of the price (gifts) are available on request to contact@xaviers.photo before dispatch, under the conditions stated on the “Shipping & returns” page.
7.4 Shipping charges. Shipping charges depend on the destination and on the size band of the work (longest overall dimension, frame included). They apply per print and are added together when an order contains several prints, each work being packed separately. The current schedule is as follows:

The largest size that can be ordered online is 275 cm overall. French Polynesia, New Caledonia and Wallis and Futuna: €300 up to 85 cm; beyond that, as for other distant destinations, shipping is agreed with the Seller before the order — please contact us at contact@xaviers.photo. These amounts include VAT for mainland France and the European Union; for other destinations they are exempt from VAT. The exact amount is shown on the work’s page according to the chosen size, then again before payment is confirmed. Paper prints ordered without framing travel rolled in a tube: they are charged at the first band up to 130 cm and at the second beyond that, whatever the size.
7.5 Deliveries outside the European Union. Customs duties, import VAT and any local taxes are payable by the Client to the carrier on arrival, which may add a handling fee (Incoterm DAP). For deliveries to the United States: works of art and photographs currently benefit from exemptions from US customs duties; as US customs regulations are subject to change, any duties, import taxes and local taxes (sales tax/use tax) remain the sole responsibility of the Client.
7.6 Receipt. On receipt, the Client is asked to check the condition of the packaging and of the work in the presence of the courier and, in the event of visible damage, to refuse delivery or to write precise, reasoned reservations on the delivery record, then to inform the Seller within forty-eight hours at contact@xaviers.photo, with photographs, so that the claim can be filed with the insurer within the seven-day period it imposes. In accordance with Articles L. 216-4 and L. 221-15 of the French Consumer Code, risk passes to the Client when they take possession of the work and the Seller remains liable for the proper performance of the delivery; the absence of reservations does not deprive the Client of the guarantees provided for in Articles 8 and 9. Please note that, in the absence of reservations, any action against the carrier is time-barred after three days under Article L. 133-3 of the French Commercial Code, extended to ten days under the conditions of Article L. 224-65 of the Consumer Code.
Article 8 — Works made to order and right of withdrawal
XAVIER S. art prints are works made to order: each copy is printed, numbered and signed specifically for the Client, according to the choices they express when ordering (dimensions, printing technique, finish and, where applicable, framing). No copy is held in stock prior to the order.
Consequently, in accordance with article L.221-28, 3° of the French Consumer Code, which excludes the right of withdrawal for goods made to the consumer’s specifications or clearly personalised, the sale of a XAVIER S. art print does not carry a right of withdrawal.
The Client is informed of this exclusion clearly and in advance, before validating their order, and expressly accepts it by ticking the box provided for that purpose at the time of payment. This information is restated on the order form and on the delivery note provided to them.
The signing of the work’s delivery note, carried out electronically from the “My orders” area on xaviers.photo, attests that the work has been delivered conforming and in perfect apparent condition. It triggers the conversion of the provisional certificate of authenticity into the final certificate of authenticity, available in digital form (bearing a verification QR code, accessible from the “My orders” area) and in a paper version delivered with the work. The work is also accompanied by its numbered back authentication label signed by the Artist.
This exclusion of the right of withdrawal deprives the Client of no legal guarantee: the legal guarantee of conformity (articles L.217-3 et seq. of the French Consumer Code) and the guarantee against hidden defects (articles 1641 et seq. of the French Civil Code) remain fully applicable (see Article 9). In the event of a work damaged in transit or not conforming to the order, the Artist bears the cost of return as well as replacement or refund, at no cost to the Client.
A return is therefore possible only if the work arrives damaged or does not match the options of the order (printing technique, format, finish, framing, print number). In both cases the Artist covers the full cost of return and replacement, under the conditions set out in Articles 7 and 9.
Article 9 — Guarantees
The Artist is bound by the legal guarantees of conformity (articles L.217-3 et seq. of the French Consumer Code) and against hidden defects (articles 1641 et seq. of the French Civil Code). These guarantees entitle the Client to a replacement, a refund or a price reduction in the event of a defect affecting the work.
Any claim must be sent by email to contact@xaviers.photo, accompanied by photographs of the defect and the certificate of authenticity, within a reasonable time of its discovery.
The following statutory notice is required by article D. 211-2 of the French Consumer Code and is reproduced here verbatim in French, as the sale is governed by French law.
Garanties légales — encadré prévu à l’article D. 211-2 du code de la consommation
Le consommateur dispose d’un délai de deux ans à compter de la délivrance du bien pour obtenir la mise en œuvre de la garantie légale de conformité en cas d’apparition d’un défaut de conformité. Durant ce délai, le consommateur n’est tenu d’établir que l’existence du défaut de conformité et non la date d’apparition de celui-ci.
Lorsque le contrat de vente du bien prévoit la fourniture d’un contenu numérique ou d’un service numérique de manière continue pendant une durée supérieure à deux ans, la garantie légale est applicable à ce contenu numérique ou ce service numérique tout au long de la période de fourniture prévue. Durant ce délai, le consommateur n’est tenu d’établir que l’existence du défaut de conformité affectant le contenu numérique ou le service numérique et non la date d’apparition de celui-ci.
La garantie légale de conformité emporte obligation pour le professionnel, le cas échéant, de fournir toutes les mises à jour nécessaires au maintien de la conformité du bien.
La garantie légale de conformité donne au consommateur droit à la réparation ou au remplacement du bien dans un délai de trente jours suivant sa demande, sans frais et sans inconvénient majeur pour lui.
Si le bien est réparé dans le cadre de la garantie légale de conformité, le consommateur bénéficie d’une extension de six mois de la garantie initiale.
Si le consommateur demande la réparation du bien, mais que le vendeur impose le remplacement, la garantie légale de conformité est renouvelée pour une période de deux ans à compter de la date de remplacement du bien.
Le consommateur peut obtenir une réduction du prix d’achat en conservant le bien ou mettre fin au contrat en se faisant rembourser intégralement contre restitution du bien, si :
1° Le professionnel refuse de réparer ou de remplacer le bien ;
2° La réparation ou le remplacement du bien intervient après un délai de trente jours ;
3° La réparation ou le remplacement du bien occasionne un inconvénient majeur pour le consommateur, notamment lorsque le consommateur supporte définitivement les frais de reprise ou d’enlèvement du bien non conforme, ou s’il supporte les frais d’installation du bien réparé ou de remplacement ;
4° La non-conformité du bien persiste en dépit de la tentative de mise en conformité du vendeur restée infructueuse.
Le consommateur a également droit à une réduction du prix du bien ou à la résolution du contrat lorsque le défaut de conformité est si grave qu’il justifie que la réduction du prix ou la résolution du contrat soit immédiate. Le consommateur n’est alors pas tenu de demander la réparation ou le remplacement du bien au préalable.
Le consommateur n’a pas droit à la résolution de la vente si le défaut de conformité est mineur.
Toute période d’immobilisation du bien en vue de sa réparation ou de son remplacement suspend la garantie qui restait à courir jusqu’à la délivrance du bien remis en état.
Les droits mentionnés ci-dessus résultent de l’application des articles L. 217-1 à L. 217-32 du code de la consommation.
Le vendeur qui fait obstacle de mauvaise foi à la mise en œuvre de la garantie légale de conformité encourt une amende civile d’un montant maximal de 300 000 euros, qui peut être porté jusqu’à 10 % du chiffre d’affaires moyen annuel (article L. 241-5 du code de la consommation).
Le consommateur bénéficie également de la garantie légale des vices cachés en application des articles 1641 à 1649 du code civil, pendant une durée de deux ans à compter de la découverte du défaut. Cette garantie donne droit à une réduction de prix si le bien est conservé ou à un remboursement intégral contre restitution du bien.
Article 10 — Intellectual property and use
The purchase of a print conveys ownership of the material object (the print and its certificate) but conveys no assignment of copyright in the photographic work. In particular, the Client is not authorised to:
- Reproduce the work in any form whatsoever
- Publicly disseminate the work (press, commercial exhibitions, social media for a third party’s promotional purposes)
- Modify or distort the work
- Make new prints
The purchased work may be displayed in a private setting, lent free of charge or resold on the secondary market. Resale conveys no right of reprinting.
Article 11 — Transfer of ownership
Transfer of ownership of the work is subject to full payment of the price. Transfer of risk (loss, theft, damage) occurs upon actual delivery to the Client.
Article 12 — Secondary market and resale right
In accordance with article L.122-8 of the French Intellectual Property Code, the Artist benefits from a resale right on any resale of the work by an art-market professional (gallery, auction house), at 4% of the resale price excluding VAT above €750 (degressive rate above €50,000). This right does not apply to sales between private individuals.
Article 13 — Liability
The Artist cannot be held liable for any indirect damage (operating loss, commercial prejudice, etc.) or for any event of force majeure as defined by French case law.
Article 14 — Personal data
Personal data collected in connection with orders are processed in accordance with the General Data Protection Regulation (GDPR) and the French Data Protection Act. See the Privacy Policy for details of purposes, retention periods and the Client’s rights.
Article 15 — Mediation and dispute resolution
If you have not managed to resolve your dispute after sending us a written complaint (letter or email), dated, setting out the circumstances giving rise to the disagreement and what you are claiming, you may refer the matter to the consumer mediator designated below, provided you have received a negative written reply from us or have received no reply within two months of sending your complaint.
In accordance with articles L.616-1 and R.616-1 of the French Consumer Code, we have put in place a consumer mediation scheme.

Article 16 — Governing law
These T&Cs are governed by French law. Any dispute will be brought before the competent French courts, unless mandatory provisions state otherwise.
